NM Talks Healthcare Podcast: Creating and Maintaining Privilege Over Internal Investigations

Members of Nelson Mullins Encompass and Charlotte partners Travis Bustamante and Julia Hartley were recently featured on the NM Talks Healthcare Podcast where they discussed e-discovery in the healthcare space, focusing on privilege, and internal investigations.

Washington, D.C. partner and Nelson Mullins healthcare attorney Hannah Cross moderated the discussion as the Encompass members analyzed internal investigations in the healthcare space, privileged investigations, the individuals often involved in internal investigations, the two privileges in internal investigations, and other timely topics.

Bustamante’s litigation practice focuses on electronic discovery, data breach response efforts, and helping companies respond to government investigations and inquiries. He also has experience counseling Fortune 500 healthcare, financial services, and pharmaceutical clients in large-scale litigation and in response to regulatory inquiries by the U.S. Department of Justice and various state attorney generals during all phases of the electronic discovery reference model.

Cross focuses her practice on healthcare law and has experience advising and counseling hospital systems, physician practice groups, pharmacies, and other healthcare providers. Her practice concentrates on regulatory compliance, with emphasis on the Stark Law and the Anti-Kickback Statute, Medicare and Medicaid reimbursement/billing compliance, compliance program guidance, and internal investigations.

Hartley is a partner who practices in the areas of electronic discovery, information management, business litigation, antitrust litigation, and data breach litigation. She serves as discovery counsel to clients in complex litigation, advising them regarding discovery response strategy, search and review methodologies, and e-discovery challenges. Prior to concentrating on electronic discovery, she litigated commercial, business, and employment cases.
