Apple’s New Messaging Features Will Complicate E-Discovery

In an article authored for Law360 about e-discovery considerations of Apple’s new iOS16 mobile operating system, partner Jarrett Coco outlines how the new system works, including features that allow users to edit and recall text messages, with some exceptions, and the ability to recover deleted text messages within 30 days. He also discusses what these new features mean for e-discovery professionals, why they are important, and what the profession can expect to see next.
“Time will tell the extent of the impact that the new iOS16 functionality will have on e-discovery, but it is probably a good idea to start thinking about how these new functions could affect your processes and policies. Planning and adjusting now may pay off later when an iOS16 device surfaces in a litigation or investigation,” he wrote.
