Preserving Privilege: Basic Principles and Best Practices

Nelson Mullins is proud to sponsor an upcoming continuing legal education (CLE) event hosted by the Association of Corporate Counsel (ACC) of Northeast Ohio. This one-hour session will delve into the fundamentals of attorney-client privilege and work product doctrine, and address the issues in-house counsel commonly face regarding these protections.

Electronic discovery attorneys, Lucie Cohen and Lianna Donovan, will be speaking at the event. Topics covered include the challenges of differentiating between business and legal communications, avoiding unintended waiver, and preparing defensible privilege logs.

Cohen is a partner in the Columbia office who serves as discovery counsel to clients in complex litigation matters and government investigations, developing discovery response strategies, negotiating electronic storage information (ESI) protocols and other discovery orders, and advocating on behalf of clients regarding scope of discovery, burden issues, and culling and search methodologies. Her clients often face interrelated litigation and government inquiries in antitrust, data breach, and other contexts, and she works closely with clients to coordinate discovery strategy and operations across matters. 

Donovan, a partner in the Charlotte office, practices in the areas of electronic discovery, records and information governance, cybersecurity and data privacy, and business litigation. She has experience counseling Fortune 500 healthcare and pharmaceutical clients in developing discovery strategies in large-scale litigation and in response to government investigations, including managing document collection, review, and production. Donovan also frequently advises clients on document preservation issues, including the development and implementation of defensible records retention and data disposal programs.
